Biography

William Miller has been practicing law for over 30 years, predominantly focused on civil litigation and litigation avoidance in various areas of specialties. Mr. Miller has been a Partner at Higgs Fletcher & Mack, LLP since joining HFM in 1999, having previously been a Partner with the firm of McInnis, Fitzgerald, Rees, Sharkey & McIntyre. To date, he has successfully tried numerous matters to jury verdict, as well as successfully tried numerous binding and non-binding arbitrations to favorable awards. Mr. Miller has represented businesses, health care providers, as well as national health care entities in business litigation, professional liability, as well as licensing investigations and disciplinary matters. His practice has also included product liability defense, defense of elder/dependent Abuse claims, and various other matters.

Mr. Miller’s notable trial and binding arbitration experience includes a six-week wrongful death trial (verdict in favor of clients), an eight-week professional liability and battery trial involving alleged brain damage and damages of $15 million (verdict in favor of clients), numerous other professional liability trials (with verdicts in favor of clients), and a favorable binding arbitration award in an intellectual property dispute (successfully defending a $7 million claim, and also obtaining a verdict in excess of $400,000 on a cross-complaint).

He has also represented a national, publicly traded, health care entity in the defense of class action claims. Notable settlements include a $3.45 million settlement in real estate claims brought against Bank of America, as well as various other favorable settlements. His experience has resulted in several favorable California Court of Appeal decisions, and the published California Supreme Court decision of Daniel Berglund vs. Arthroscopic & Laser Surgery Center of San Diego, LP, et al. (2008) 44 C.4th 528.
